26-001 (WASHINGTON STREET): THE VACATION OF AN UNDEVELOPED RIGHT OF WAY, BEING A CONTINUATION OF WASHINGTON STREET IN MINERAL

Order of Vacation: 26-001 (Washington)

RCW 36.87 allows for the vacation of a county road that is found useless to the needs of the County pending a report of the County Engineer

First: On April 8, 2026, the County Engineer filed his report in writing with the Lewis County Board of County Commissioners (BOCC) setting forth all things required by law to be set forth in the County Engineer's report

Second: On April 14, 2026, the BOCC passed Resolution 26-118, which fixed the 19th day of May 2026, at or after 10 a.m., in the Commissioner's Hearing Room on the second floor of the Historic Courthouse, Chehalis, Lewis County, Washington, as the time and place for the hearing on the report of the County Engineer, and that the BOCC duly caused notice thereof to be published and posted as required by law

Third: That said portion of road does not abut a body of water

Fourth: An easement for all existing utilities for the repair and maintenance of those public utilities, including the right of ingress and egress, will be reserved by Lewis County and remain in effect until such time as replacement easements are filed and recorded with the County Auditor’s office.

NOW THEREFORE IT IS ORDERED the vacation of Washington Street lying westerly of Lincoln Ave, as shown on the plat of Mineral Lake Lumber Company's 1st Addition to Mineral, Washington, came regularly on for hearing, and due proof having been made to the satisfaction of the BOCC by affidavit of the posting and publication of the notices of hearing and BOCC having considered the engineer's report and all the evidence relative to such vacation, now here finds that the above described portion of Washington Street is not to the County Road system and the Order of Vacation No. 26-001 is approved.

DONE IN OPEN SESSION this 19th day of May, 2026.
