Summary:

The property owners abutting the portion of Lindley Road No. 407 have requested that the County vacate the right of way. RCW 36.87 allows for the vacation of a county road that is found useless to the needs of the County pending a Report of the County Road Engineer. Resolution 25-029, passed by the Board of County Commissioners (BOCC) January 28th, 2025, directed the County Road Engineer to examine Lindley Road  No. 407 right of way, and report his opinion to the BOCC. On March 12, 2025, the Engineer's Report on the matter of the proposed vacation of a portion of Lindley Road North No. 407, was filed with the BOCC. The report and all related materials having been reviewed by the BOCC and found appropriate for further proceedings. This resolution sets April 22, 2025, at or after the hour of 10:00 a.m., in the BOCC Hearing Room on the 2nd floor of the Historic Courthouse in Chehalis, Washington, as the time and place for the hearing on the County Engineer's Report. The resolution also calls for the Clerk of the Board to proceed with all the necessary notifications, posting and publication.

Resolution

WHEREAS, RCW 36.87 allows for the vacation of a County road that is found useless to the needs of the County pending a Report of the County Road Engineer; and

WHEREAS, Resolution 25-029, passed by the Board of County Commissioners (BOCC) on January 28, 2025, directed the County Road Engineer to examine Lindley Road No. 407 right of way and to report his findings to the BOCC; and

WHEREAS, as required by RCW 36.87, March 12, 2025, the report of the County Road Engineer on the matter of the proposed vacation of the following described portion of Lindley Road No. 407 right of way, was filed in the office of the BOCC, to wit:

All that portion of Lindley Road No. 407 (also known as Topelt Road #379 and Elk Creek Road #204) lying Westerly of the Left bank of the Chehalis River and Southerly of the Lindley Road extension No. 407-B as recorded under AFN 651788, also any portion lying within Tract No. 2 shown on Exhibit “A” under agreement document recorded under AFN 671097, lying within the Northwest Quarter of the Northwest Quarter (NW1/4 NW4) in Section 11, and the Southwest Quarter of the Southwest Quarter (SW1/4 SW1/4) in Section 2, situated in Township 13 North, Range 5 West, W.M.; and

WHEREAS, the report and all related materials having been reviewed by the BOCC and found appropriate for further proceedings.

NOW THEREFORE BE IT RESOLVED that April 22, 2025, at or after the hour of 10:00 a.m. in the Commissioners' Hearing Room on the 2nd floor of the Historic Courthouse in Chehalis, Washington, has been fixed as the time and place for the hearing on the County Road Engineer's Report, when and where all persons may appear and be heard upon report and upon the matter of the vacation of that road described above. NOW THEREFORE BE IT FURTHER RESOLVED that the Clerk of the Board is hereby instructed to proceed with all that necessary notifications, posting and publication.
