Summary:

A property owner has requested the vacation of an unimproved Right of Way, lying between Cowlitz and Hanes in Packwood. Resolution 23-162, passed by the Board of County Commissioners (BOCC) on May 16th, 2023, directed the County Road Engineer to examine that portion of undeveloped Right of Way, and report his opinion to the BOCC.  On May 31st, 2023, the Engineer's Report on the matter of the proposed vacation was filed with the BOCC.  This resolution sets June 27, 2023, at or after the hour of 10:00 a.m., in the BOCC Hearing Room on the 2nd floor of the Historic Courthouse in Chehalis, Washington, as the time and place for the hearing on the County Engineer's Report.  The resolution also calls for the Clerk of the Board to proceed with all the necessary notifications, posting, and publication.

WHEREAS, RCW 36.87 allows for the vacation of a county road that is found useless to the needs of the County pending a report from the County Road Engineer; and

WHEREAS, Resolution 23-162, passed by the BOCC on May 16, 2023, directed the County Road Engineer to examine an undeveloped Right of Way in Packwood and report his findings to the Board of County Commissioners (BOCC); and

WHEREAS, as required by RCW 36.87, the County Road Engineer's report on the matter of the proposed vacation of the following described right of way was filed in the office of the BOCC on May 31, 2023, to wit:

The undeveloped Right of Way as shown on an unrecorded map filed in the records of Lewis County, titled, “Village of Packwood”, dated 1958, being a width of 16 feet, and located approximately 60 feet East of the easterly boundary of block 3 of the “Map of Lewis” plat, dated July 22, 1910, located in Book 1, Page 166, of the records of Lewis County, Washington; and

WHEREAS, the report and all related materials having been reviewed by the BOCC and found appropriate for further proceedings.

NOW THEREFORE BE IT RESOLVED that the hearing on the County Road Engineer's Report will take place in the BOCC Hearing Room on the second floor of the Historic Courthouse in Chehalis, Wash., at or after 10 a.m. June 27, 2023, when and where all persons may appear and be heard upon report and upon the matter of the vacation of that undeveloped road described above. Interested parties are encouraged to check the Commissioners' hearing schedule online at https://lewiscountywa.gov/offices/commissioners/agenda-calander as the hearing date approaches for updated details; and

NOW THEREFORE BE IT FURTHER RESOLVED that the Clerk of the Board is hereby instructed to proceed with all necessary notifications, posting and publication.
