Summary:

A property owner has requested the vacation of a portion of the Loren LaBree Road No. 328, South of Chehalis. RCW 36.87 allows for the vacation of a county road that is found useless to the needs of the County pending a Report of the County Road Engineer. Resolution 20-396, passed by the Board of County Commissioners (BOCC) November 9, 2020, directed the County Road Engineer to examine a portion of the Loren LaBree Road No. 328 right of way, and report his opinion to the BOCC. On November 30, 2020 the Engineer's Report on the matter of the proposed vacation of a portion of Loren LaBree Road No. 328, was filed with the BOCC. The report and all related materials having been reviewed by the BOCC and found appropriate for further proceedings. This resolution sets January 4, 2021, at or after the hour of 10:00 a.m., in the BOCC Hearing Room on the 2nd floor of the Historic Courthouse in Chehalis, Washington, as the time and place for the hearing on the County Engineer's Report. The resolution also calls for the Clerk of the Board to proceed with all the necessary notifications, posting and publication.

Resolution

WHEREAS, RCW 36.87 allows for the vacation of a county road that is found useless to the needs of the County pending a Report of the County Road Engineer; and

WHEREAS, Resolution 20-396, passed by the Board of County Commissioners (BOCC) on November 9, 2020, directed the County Road Engineer to examine a portion of Loren LaBree Road No. 328 right of way and to report his findings to the BOCC; and

WHEREAS, as required by RCW 36.87, November 30, 2020, the report of the County Road Engineer on the matter of the proposed vacation of the following described portion of Loren LaBree Road No. 328 right of way, was filed in the office of the BOCC, to wit:

All of the Loren LaBree Road No. 328 lying between Bishop Road and Interstate 5, being located in the South Half of the  Northeast Quarter ( S1/2 NE1/4) of Section 9, Township 13 North, Range 2 West, W.M.; and

WHEREAS, the report and all related materials having been reviewed by the BOCC and found appropriate for further proceedings.

NOW THEREFORE BE IT RESOLVED that January 4, 2021, at or after the hour of 10:00 a.m. in the Commissioners' Hearing Room on the 2nd floor of the Historic Courthouse in Chehalis, Washington, has been fixed as the time and place for the hearing on the County Road Engineer's Report, when and where all persons may appear and be heard upon report and upon the matter of the vacation of that road described above. NOW THEREFORE BE IT FURTHER RESOLVED that the Clerk of the Board is hereby instructed to proceed with all that necessary notifications, posting and publication.
