Order of Vacation: 26-002 (Fagley Rd.)

RCW 36.87 allows for the vacation of a county road that is found useless to the needs of the County pending a report of the County Engineer

First: On May 27, 2026, the County Engineer filed his report in writing with the Lewis County Board of County Commissioners (BOCC) setting forth all things required by law to be set forth in the County Engineer's report

Second: On June 16, 2026, the BOCC passed Resolution 26-180, which fixed the 14th day of July 2026, at or after 10 a.m., in the Commissioner's Hearing Room on the second floor of the Historic Courthouse, Chehalis, Lewis County, Washington, as the time and place for the hearing on the report of the County Engineer, and that the BOCC duly caused notice thereof to be published and posted as required by law

Third: That said portion of road does not abut a body of water

Fourth: this vacation shall reserve easements over, under, and across the vacated right of way as necessary to preserve access rights for abutting property owners and to accommodate existing and future utility facilities, including but not limited to water, sewer, stormwater, power, telecommunications, and franchise utilities. (RCW 36.87.140)

NOW THEREFORE IT IS ORDERED the vacation of, all that part of the following described portion of the undeveloped right of way, beginning at a point that bears S47°49'W 1470.4 feet from the Quarter Section corner common to Sections 3 & 4, T14N, R3W, W.M., running thence in a Westerly direction to the East line of the W 1/2, of the NW 1/4, of the SE 1/4, Section 4, T14N R3W, W.M., known as Fagley Road #609 in Centralia, Washington, reserving easements over, under, and across the vacated right of way as necessary to preserve access rights for abutting property owners and to accommodate existing and future utility facilities, including but not limited to water, sewer, stormwater, power, telecommunications, and franchise utilities. (RCW 36.87.140), came regularly on for hearing, and due proof having been made to the satisfaction of the BOCC by affidavit of the posting and publication of the notices of hearing and BOCC having considered the engineer's report and all the evidence relative to such vacation, now here finds that the above described portion of Fagley Road #609 is not useful to the County Road system and the Order of Vacation No. 26-002 is approved.

DONE IN OPEN SESSION this 14th day of July, 2026.
