Summary:

The County Engineer has determined that all of Lindley Road No. 407, in Sections 11 & 2, Township 13 North, Range 05 West, W.M., should be vacated and abandoned for the reason that it is useless as a part of the County Road system and that the public will benefit by its vacation and abandonment.  The report and all related materials having been reviewed by the BOCC and found appropriate for further proceedings

Vacation

First:  On March 12, 2025, the County Road Engineer filed his report in writing with the Lewis County Board of County Commissioners (BOCC) setting forth all things required by law to be set forth in the county engineers report.

Second:  On March 25, 2025, the BOCC passed Resolution 25-081, which fixed the 22nd day of April 2025, at or after 10 a.m., in the Commissioner's Hearing Room on the second floor of the Historic Courthouse, Chehalis, Lewis County, Washington, as the time and place for the hearing on the report of the County Engineer, and that the BOCC duly caused notice thereof to be published and posted as required by law.

Third: That said portion of road does not abut a body of water.

Fourth: An easement will be retained by the County for the construction, repair, and maintenance of public utilities and services that are physically located within the right of way being vacated, pursuant to RCW 36.87.140.

NOW THEREFORE IT IS ORDERED the vacation of all that portion of Lindley Road No. 407 right of way lying within the Northwest Quarter of the Northwest Quarter (NW1/4 NW1/4) in Section 11, and the Southwest Quarter of the Southwest Quarter (SW1/4 SW1/4) in Section 2, situated in Township 13 North, Range 5 West, W.M., as shown on Exhibit A, came regularly on for hearing, and due proof having been made to the satisfaction of the BOCC by affidavit of the posting and publication of the notices of hearing and BOCC having considered the engineer's report and all the evidence relative to such vacation, now here finds that the above described portion of Lindley Road is not useful to the County Road system and the Order of Vacation No. 25-002 is approved.
