A quarterly fee of $5,750 will be charged for the twelve (12) months beginning on the effective date of this Contract.
- It is agreed that the above fees are based on a monthly average of filed claims for a full fiscal year of no more than (1.) __sixty (60)_, including reopening of claims. Should the number of claims filed for a full fiscal year exceed (2.) __sixty (60)_, the parties agree that a fee of _$500.00_ shall be billed for each of the claims that exceed the number in (2.) above.

RENEW PROFESSIONAL SERVICES CONTRACT WITH PENSER NORTH AMERICA FOR WORKERS’ COMPENSATION THIRD-PARTY ADMINISTRATION
WHEREAS, Lewis County maintains a self-insurance program to cover Workers' Compensation liabilities; and
WHEREAS, Lewis County has contracted with Penser North America for administrative and supervisory functions in connection with workers' compensation claims made against Lewis County since 2006; and
WHEREAS, Penser North America shall continue to perform the usual and necessary administrative and supervisory functions in connection with claims made against Lewis County for occupational injuries, illnesses, diseases, and deaths during the agreement period, with the exception of those functions waived in writing by Lewis County; and
WHEREAS, Penser North America agrees to provide, at its expense, a competent, certified claims adjudicator/administrator and support staff as sufficient to supervise and handle Washington Workers' Compensation claims according to the law and rules of the State of Washington.
NOW THEREFORE BE IT RESOLVED the BOCC approves the amended contract for five (5) years commencing upon the effective date of this contract, and renewing annually thereafter unless terminated for a fee of $5,750 quarterly based on a monthly average of claims and authorizes the Budget and Risk Director to sign the agreement.
