Information
No additional impact to .09 funds will occur; this merely allows further use of the already-contracted funds.
Type: Deliberation
Department: CM - County Manager (including Budget)
Directors' Update: May 1, 2024
Business Meeting: May 7, 2024
Summary:This resolution amends an existing .09 grant agreement between the County and the Chehalis River Basin Flood Control Zone District (FCZD). The prior contract supported environmental review of the FCZD's proposed flow-through dam for flood control, a public facility serving economic development purposes, by providing funds to advance engineering in the environmental review process. There is around $170,000 left of unspent funds in the contract. To further support for environmental review for the project, this amendment would allow the remaining funds to be used for land acquisition and associated costs to bank properties for potential mitigation, if the project is chosen. This will help demonstrate that mitigation for the project's impacts is feasible, which is a necessary component of environmental review.

APPROVING AN AMENDMENT TO A GRANT AGREEMENT FOR .09 ("DISTRESSED COUNTIES") MONIES FOR THE CHEHALIS RIVER BASIN FLOOD CONTROL ZONE DISTRICT
WHEREAS, on June 1, 2020, via Resolution 20-185, the County approved a grant agreement for .09 funds for the Chehalis River Basin Flood Control Zone District to support environmental review of the FCZD's proposed flow-through dam for flood control, a public facility serving economic development purposes, by providing funds to advance engineering in the environmental review process; and
WHEREAS, there remain unspent funds under that grant agreement; and
WHEREAS, the purpose of supporting environmental review of the flood facility can be further served by allowing the funds to be used for land acquisition and associated costs to bank properties for potential mitigation, if the project is chosen for construction; and
WHEREAS, this action will help demonstrate that mitigation for the flood facility's impacts is feasible, which is a necessary component of environmental review; and
WHEREAS, the Commissioners have reviewed the amended .09 grant agreement and determined the amendment to be within the proper scope of .09 funds and consistent with the intent and purpose of the original agreement; and
WHEREAS, the Comprehensive Economic Development Strategy (CEDS) maintained by the Economic Alliance of Lewis County must be conformed to the amended .09 grant agreement for statutory compliance.
NOW THEREFORE BE IT RESOLVED that the amendment to the .09 grant agreement is in the public interest and is approved. The Economic Alliance of Lewis County is requested to amend the entry in the CEDS related to this contract to list the brief description of the project as "advancing engineering for continued development of, and land acquisition and associated costs to bank properties for potential mitigation for, the proposed flood retention facility".
DONE IN OPEN SESSION this 7th day of May, 2024.
