Resolution
APPROVE THE FIRST AMENDMENT TO THE AGREEMENT OF PURCHASE AND SALE OF WATER ASSETS BY AND BETWEEN THE CITY OF VADER AND LEWIS COUNTY
WHEREAS, Lewis County and the City of Vader entered into an Agreement of Purchase and Sale of Water Assets by and between the City of Vader and Lewis County on or about February 24, 2014, whereby the City transferred its Water System to County; and
WHEREAS, the Agreement contained provisions for the County to retransfer the Water System back to the City of Vader should certain specified conditions outlined in Section 16 of the Agreement be met on or before December 16, 2023; and
WHEREAS, the City of Vader has requested an extension of the deadline to December 16, 2025; and
WHEREAS, Lewis County is willing to agree to an extension of the request deadline provided the City of Vader agrees to certain additional conditions and considerations as set forth in the Amendment.
NOW THEREFORE BE IT RESOLVED the Board of County Commissioners (BOCC) hereby approves the Amendment to the purchase and sale Agreement according to the terms outlined in the First Amendment attached to the Resolution as Exhibit "I" and authorizes the Public Works Director to sign on behalf of the BOCC.
