Summary:

This resolution will authorize the initiation of condemnation proceedings to acquire necessary right of way associated with the Centralia Alpha Road Improvement Project (CRP 2084).

WHEREAS, the Lewis County Transportation Improvement Plan includes the Centralia Alpha Road Improvement Project; and

WHEREAS, RCW 8.08.010 empowers the County to condemn land for public use when deemed necessary for public purposes; and

WHEREAS, on May 11, 2021, the Board of County Commissioners (BOCC) passed Resolution 21-189, instructing the County Road Engineer to acquire all necessary right of way for the Centralia Alpha Road project under its eminent domain authority; and

WHEREAS, negotiations have not been successful in acquiring right of way from two property owners and will require condemnation; and

WHEREAS, on March 21, 2023, the BOCC passed Resolution 23-098 instructing the Public Works Department to proceed with all necessary notifications and publications required by RCW 8.25.290; and

WHEREAS, notice of planned final action has been given by publication once a week for two successive weeks; and

WHEREAS, the property owners of record have been sent notice of planned final action by certified mail.

NOW THEREFORE BE IT RESOLVED that the Prosecuting Attorney is hereby directed to initiate condemnation proceedings to acquire and not to exceed said right of way described in attached Exhibit "A".
