Summary:

Lewis County issued a call for bid for the material purchase of rock for the 2021 3R program throughout Lewis County on December 22, 2020. WSDOT 2020 Standard Specification Section 1-03 (Consideration of Bids) and supplemental language in the Contract Special Provisions state all bids are likely to be rejected if the lowest responsive bid received exceeds the Engineer's Estimate by an unreasonable amount.  One bid was received for the purchase of rock on January 12, 2021 and it exceeded the Engineer's Estimate by 100%. Additionally, RCW 36.32.250 allows for the rejection of all bids if a compelling reason exists.

Public Works recommends the Board of County Commissioners reject all bids for the material purchase of rock for the 2021 3R program

Resolution

WHEREAS, RCW 36.32.250 allows for the preservation of the integrity of the competitive bid system and dictates that after competitive bids have been opened, award must be made to that responsible bidder who submitted the lowest responsive bid, unless there is a compelling reason to reject all bids and cancel the solicitation; and

WHEREAS, Lewis County received and opened one (1) bid for the material purchase of rock for the 2021 3R program on January 12, 2021; and

WHEREAS, the bid was more than 100% over the Engineer’s Estimate; and

WHEREAS, Public Works anticipates receiving more competitive bids if we re-bid this project; and

WHEREAS, it appears to be in the best public interest to reject all bids for the material purchase of rock for the 2021 3R program.

NOW THEREFORE BE IT RESOLVED that all bids accepted by Lewis County on January 12, 2021, for the material purchase of rock for the 2021 3R program are hereby rejected under the authority of RCW 36.32.250.
