Summary:

The property owner abutting an unimproved right of way known as Alley in Block B of the Plat of Doty, in Doty, has requested the County vacate this right of way. Any and all interest other than the requesting parties will be evaluated as part of the County Engineer's Report.

Passing this resolution would instruct the County Engineer to examine the portion of right of way, evaluate the request, and file an engineer's report, as required by RCW 36.87.030 and LCC 12.15.  A copy of the request from the property owner is attached, and all associated fees have been paid in advance.

Resolution

WHEREAS, RCW 36.87 authorizes the Board of County Commissioners (BOCC) to vacate useless county roads or portions thereof; and

WHEREAS, the BOCC has received information indicating the undeveloped right of way known as Alley in Block B of the Plat of Doty, in Doty, Wash., may be useless as part of the county road system and that the public may be benefitted by its vacation, and the BOCC intends to proceed determining whether the road should be vacated and abandoned; and

WHEREAS, when considering vacation of a county right of way, the BOCC may by resolution declare its intention to vacate the right of way and direct the County Engineer to report on such vacation; and

WHEREAS, the petitioner has paid all administrative fees and publication costs associated with this vacation.

NOW THEREFORE BE IT RESOLVED that the County Engineer is instructed to examine all that part of an undeveloped 12' Alley right of way in Block B in the Plat of Doty, located in the Northwest 1/4 of the Southwest 1/4, Section 2, T13N R5W, W.M., Lewis County, WA, beginning at the Southeast corner of lot 7, thence continuing northeasterly 722' to the northeast corner of lot 20, thence southeasterly 12' along the northerly line of block B to the Northwest corner of Lot 21, thence Southwesterly 722' to the Southwest corner of Lot 34, thence Northwesterly 12' to the point of beginning, as required by RCW 36.87.030 and LCC 12.15 and report his recommendations to the BOCC.
