Summary:

The Categorized Fee Schedule will be amended to address RCW 70.77.555 which limits the amount that a county (or city) may charge for a firework stand to a total of $100 for all permits to and through processing, issuance and inspection.  In Lewis County, the owner/operator of a firework stand obtains a building permit from Community Development. Because an automatic $50 administrative fee is charged on all building permits to cover the cost of processing the application, the building permit fee for a firework stand, for one season, will be reduced to $50, making the total cost of a permit $100.

Resolution

WHEREAS, Chapter 18.05 LCC authorizes Lewis County Community Development to charge fees for building permits and other approvals and reviews; and

WHEREAS, section 18.05.020(1) LCC allows the fee schedule to be changed from time to time through a resolution of the Board of County Commissioners; and

WHEREAS, the current Categorized Fee Schedule was adopted by Resolution 24-416 on November 12, 2024, and took effect on January 1, 2025; and

WHEREAS, the current Categorized Fee Schedule includes a fee of $110 for "Firework Stand (includes one inspection)" on page 12, as well as an administrative fee of $50, for a total fee of $160; and

WHEREAS, RCW 70.77.55(1) states, "A city or county may provide by ordinance for a fee in an amount sufficient to cover all legitimate costs for all needed permits, licenses, and authorizations from application to and through processing, issuance, and inspection, but in no case to exceed a total of one hundred dollars for any one retail sales permit for any one selling season in a year, whether June 28th through July 5th or December 27th through December 31st, or a total of two hundred dollars for both selling seasons".

NOW THEREFORE BE IT RESOLVED the Board of County Commissioners finds it in public interest to amend the Lewis County Categorized Fee Schedule to charge a fee of $50 for a Firework Stand for one season, as well as the administrative fee of $50, for a total permit fee of $100.
