AUTHORIZE THE DIRECTOR OF COMMUNITY DEVELOPMENT TO COMMENCE NEGOTIATIONS WITH THE CITY OF CENTRALIA FOR AN INTERLOCAL AGREEMENT TO ANNEX TERRITORY WITHIN THE URBAN GROWTH AREA
WHEREAS, RCW 35A.14, Annexation by Code Cities, provides alternative methods for cities to annex territory within the unincorporated urban growth area; and
WHEREAS, in 2023, the Washington State Legislature passed 2SHB 1425, which amended RCW 35A.14 to allow a new interlocal agreement method for annexing territory within the unincorporated urban growth area; and
WHEREAS, RCW 35A.14.460 allows the legislative body of a county or code city planning under chapter RCW 36.70A and subject to the requirements of RCW 36.70A.215 to initiate an annexation process for unincorporated territory by adopting a resolution commencing negotiations for an interlocal agreement as provided in RCW 39.34 RCW between a county and any code city within the county; and
WHEREAS, the City of Centralia is a code city planning under RCW 36.70A.
NOW THEREFORE BE IT RESOLVED that the Board of County Commissioners finds it in the public interest to negotiate annexation of unincorporated territory in the urban growth area and authorizes the Director of the Lewis County Department of Community Development to commence negotiations with the City of Centralia.
