Summary:

Lewis County was awarded Federal Funds for the 2021 County Safety Program.  The project entails upgrading signage, improving clear zones, flatten slopes, add/upgrade barriers, widen shoulders, remove/modify fixed objects, and reduce pavement edge drop-offs along Centralia Alpha Road.  The project is priority number 11 on the County's Six Year Transportation Improvement Program. The project will require additional road right of way from approximately 17 property owners.  The proposed acquisitions are all relatively small strips of land adjoining the present right of way. RCW Chapter 8 authorizes Counties to acquire property when deemed necessary by the Board of County Commissioners. Pursuant to the requirements of RCW Chapter 8, this resolution instructs the County Engineer to acquire right of way from approximately17 property owners along Centralia Alpha Road. All such acquisitions shall be in accordance with adopted procedures as per Resolution 20-149.

Resolution

WHEREAS, 2021 County Safety Program is priority number 11 on the County's Six Year Transportation Improvement Program approved by the Board of County Commissioners (BOCC) on November 23, 2021, by Resolution 21-412; and

WHEREAS, the improvement project will require additional road right of way from approximately 17 property owners; and

WHEREAS, this project is a necessary improvement and will benefit the public; and

WHEREAS, RCW 8.08.010 authorizes counties to acquire property when deemed necessary by the BOCC; and

WHEREAS, pursuant to the requirements of RCW 8.08, this resolution instructs the County Engineer to acquire right of way as shown on the attached exhibit from approximately 17 property owners along Centralia Alpha Road.

NOW THEREFORE BE IT RESOLVED that the County Road Engineer is instructed to acquire all necessary right of way and is authorized to sign documents necessary for the Centralia Alpha Road improvement project between Milepost 2.31 and 15.38; and

NOW THEREFORE BE IT FURTHER RESOLVED that the BOCC directs that all such acquisitions be in accordance with adopted procedures as per Resolution 20-149 and under Lewis County's eminent domain authority, as per RCW 8.25 and WAC 458-61A-206 (1c), and pursuant to authority and obligations of RCW Title 8, notably 8.08, 8.25, and 8.26.
