Summary:

The property owner abutting Meyers Road, off Larson Road in Silver Creek, has requested that the County vacate the right-of-way.  Any and all interests other than the requesting party will be evaluated as part of the Engineer's Report.

Passing the resolution would instruct the County Road Engineer to examine the portion of right-of-way, evaluate the request, and file an Engineer's Report, as required by RCW 36.87.010 and LCC 12.15.  A copy of the request from the property owner is attached, and all associated fees have been paid in advance.

Resolution

WHEREAS, RCW 36.87 authorizes the Board of County Commissioners (BOCC) to vacate useless county roads or portions thereof; and

WHEREAS, the BOCC has received information indicating that Meyers Road No. 1096 in the Silver Creek area may be useless as part of the county road system and that the public may be benefitted by its vacation, and the BOCC intends to proceed determining whether the road should be vacated and abandoned; and

WHEREAS, when considering vacation of a county road, the BOCC may by resolution declare its intention to vacate the road and direct the County Road Engineer to report on such vacation.

NOW THEREFORE BE IT RESOLVED that the County Road Engineer is instructed to examine all that part of the following described portion of Meyers Road No. 1096 as required by RCW 36.87.010 and LCC 12.15 and report his recommendations to the BOCC:

All that portion of Meyers Road No. 1096, declared to be a county road by Resolution 89-54, located in the East Half of the Southeast Quarter of the Southwest Quarter (E1/2 SE1/4 SW1/4) and West Half of the Southwest Quarter of the Southeast Quarter (W1/2 SW1/4 SE 1/4) of Section 5, Township 12 North, Range 3 East, W.M., more particularly described as beginning at the intersection of Meyers Road with Larson Road; thence along the centerline of Meyers Road in an overall Northerly direction to its terminus.
