Resolution

WHEREAS, WAC 197-11-880 defines an emergency action as that which must be undertaken immediately or within a time too short to allow full compliance with Chapter 197-11, to avoid an imminent threat to public health or safety, to prevent an imminent threat to public health or safety, to prevent an imminent danger to public or private property, or to prevent an imminent threat of serious environmental degradation; and

WHEREAS, WAC 173-27-040(2)(d) defines emergency construction as actions necessary to protect property from damage by the elements. An "emergency" is an unanticipated and imminent threat to public health, safety, or the environment which requires immediate action with a time too short to allow full compliance Chapter 90-58 RCW; and

WHEREAS, a major City of Centralia water transmission line is located close to the Little Hanaford Road Slide; and

WHEREAS, if the slide continues to move, the water line will rupture leaving the residents served at the end of Little Hanaford Road without water for up to one week; and

WHEREAS, the Little Hanaford Road Slide Repair project needs to be completed as soon as possible to prevent the rupture of the main water line; and

WHEREAS, the Federal Emergency Management Agency (FEMA) Public Assistance program will provide funding for the Little Hanaford Road Slide Repair project under the Presidentially declared disaster number FEMA-4650-DR.

NOW THEREFORE BE IT RESOLVED the BOCC declares the Little Hanaford Road Slide Repair project an emergency per WAC 197-11-880 and WAC 173-27-040(2)(d) and the Board of County Commissioner Chair is authorized to sign the agreement.
