Resolution
THE PROPOSED ESTABLISHMENT OF A NEW COUNTY ROAD OFF BAKER DRIVE, MOSSYROCK
WHEREAS, it has been determined that there is a public need for a public road lying west of the presently established Baker Drive; and
WHEREAS, RCW 36.81.010 gives the Board of County Commissioners (BOCC) the authority to declare their intent to establish a county road and direct the County Engineer to report on establishing said road.
NOW THEREFORE BE IT RESOLVED by the BOCC of Lewis County, Washington, pursuant to RCW 36.81.010 and right of way acquisition procedures adopted by Resolution 20-149, that it is their intent to establish the above referenced county road, at no less than 60 (sixty) feet in width, in the North Half of the Southeast Quarter (N1/2 SE1/4) of Section 16 Township 12 North Range 2 East W.M., lying west of the currently established Baker Drive; and
NOW THEREFORE BE IT FURTHER RESOLVED that this proposed establishment is a public necessity and will be of benefit to the community; and
NOW THEREFORE BE IT FURTHER RESOLVED all such acquisition be acquired under eminent domain authority for the purposes of real estate excise tax, as per RCW 8.25 and WAC 458-61A-206 (3), and pursuant to authority and obligations of RCW Title 8, notably 8.08, 8.25, and 8.26; and
NOW THEREFORE BE IT FURTHER RESOLVED that the County Engineer is directed to examine and, if necessary, survey the road, acquire all necessary right of way, then file his report with the BOCC, together with all maps and documents related to the establishment of said right of way, as required by RCW 36.81.
